TERMS AND CONDITIONS OF SALE
ALL BUYERS MUST REGISTER AS A BIDDER BEFORE PLACING BIDS!!SALES CONDITIONS - IMPLIED WARRANTY - THERE ARE NO IMPLIED WARRANTIES MADE BY THEBULLALLEY.COM OR BAR F PRODUCTIONS, INC. (FROM THIS POINT FORWARD KNOWN AS THE AUCTIONEER) OR OWNER AS TO THE MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR OTHERWISE OF ANY ANIMAL OFFERED FOR SALE IN THIS AUCTION. AUCTIONEER MAKES NO WARRANTIES WHATSOEVER.
BIDDING- Each animal will be sold to the highest bidder without reserve. All bidding will conclude at the stated date and close time for each auction listing. Any bid received within the last fifteen (15) minutes of the auctions conclusion will keep the auction live. Once a period of fifteen (15) minutes has passed with no live bidding, the auction will conclude.
BIDDING ERROR - Any bid placed in error, the buyer must contact administrator immediately within ten (10) minutes of the bids placement to have the bid deleted.BIDDING DISPUTE- The auctioneer in charge will settle any dispute as to bids, and the auctioneer’s decisions on such matters will be final.
RIGHT TO REFUSE BIDS - The auctioneer reserves the right to refuse to accept and/or reject and/or to ignore any bid(s) from any person(s) whomsoever; provided, however, such exclusion of or refusal to accept bid(s) shall not be made on the basis of race, sex, color or creed.
TERMS- Terms of the sale are cash due upon sale, all final online sale transactions will conclude between the buyer and seller, unless prior credit arrangements for the sale have been agreed upon in writing between buyer and seller, in which event, the terms of the written credit arrangement between buyer and seller for the sale prevail.
SETTLEMENT - The high bidder at the conclusion of the online auction will be notified as the "high bidder" of the lot purchased. Buyer will have ten (10) business days of the auction conclusion date to settle payment in full with the seller, unless other arrangements are made between the buyer and seller.
NO PAYMENT - Any buyer who does not follow through with a sale transaction within the time stated, after the bid has been finalized, will be black listed from any and all future online or live sales held by TheBullAlley.com or Bar F Productions, Inc. The only exception to this will be related to the breeding and reproduction warranty guarantees by owner ONLY.

PURCHASERS RISK - Each animal becomes the risk of the purchaser as soon as the auctioneer declares it sold.
HEALTH - All sellers will be responsible for meeting buyers current state health requirements.
ANNOUNCEMENTS - TheBullAlley.com and Bar F Productions, Inc. has made every reasonable effort to assure the correctness of information listed within this online auction site. Owners shall be responsible for any omission of announcements by auctioneer pertaining to limited warranties. TheBullAlley.com and Bar F Productions, Inc. disclaims responsibility for the consequences, if any, of any online auction listing errors. However, notification of errors would be appreciated. All guarantees, if any, other than those specifically expressed herein, shall be such as agreed upon between buyer and seller. Any representations made in online auction, which are not expressly assured by these Terms and Conditions of Sale are those of the seller only and are not assured in any way by TheBullAlley.com or Bar F Productions, Inc.
BREEDING GUARANTEES -
*OPEN FEMALES - are those females which have not been examined safe in calf or stated to be exposed or pasture bred.
*EXPOSED AND/OR PASTURE BRED FEMALES - have been exposed but are not guaranteed to be in calf.
*SAFE IN CALF - have been examined by a veterinarian and are so guaranteed. Buyer will have fourteen (14) business days to have the cattle re-examined for pregnancy. In the instance the female is not safe in calf, the buyer may return the female to the seller for a free breeding to the same sire at the seller’s expense, or return the animal to the seller for a full refund. This instance is providing that the female is in condition and compliance with the health requirements of the seller’s state. The acceptance of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The buyers failure to have the animal re-examined by a veterinarian, notify the seller, TheBullAlley.com and Bar F Productions, Inc. prior to fourteen (14) business days shall receive and absolve the seller, TheBullAlley.com and Bar F Productions, Inc. of any duty, obligation or liability to the buyer regarding the purchase of the said female. It shall be the obligation of the buyer to bear any expense incurred for the transportation in this regard. All disputes to be handled between buyer and seller.
*REPRODUCTION - Buyer will have until fourteen (14) business days to have the cattle re-examined for Reproduction problems that may exist. In the instance the female has Reproduction problems, the buyer may return the female to the seller for a full refund. This instance is providing that the female is in condition and compliance with the health requirements of the seller’s state. The acceptance of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The buyers failure to have the animal re-examined by a veterinarian, notify the seller, TheBullAlley.com and Bar F Productions, Inc. prior to fourteen (14) business days shall receive and absolve the seller, TheBullAlley.com and Bar F Productions, Inc. of any duty, obligation or liability to the buyer regarding the purchase of the said female. RIGHTS AND OBLIGATIONS - The above terms and conditions of online sale shall constitute a contract between buyer and seller of each animal and shall be equally binding upon both. Each TheBullAlley.com, Bar F Productions, Inc., nor any other person corrections with the management of the online sale assumes any liability, legal or otherwise, for any subsequent resale of an animal.
CHECK LIABILITY - The law regarding insufficient fund checks is as follows: Any person signing a personalized check in the State of Texas will be held liable for the amount of the check. Acceptable form of personal identification will be required. No post dated checks will be accepted. Appropriate legal services will be obtained in what ever state and County necessary in the United States to secure performance of any check given. These conditions will be enforced to the fullest extent of the law and no exceptions will be made. There will be a $500.00 fee for all returned checks that are not replaced with a cashiers check within 3 days of the return date of the check.
NO RETURNS OR REFUNDS - ALL SALES ARE FINAL AND BINDING. NO ANIMALS ARE SUBJECT TO RETURN AND NO REFUNDS SHALL BE MADE EXCEPT AS STATED IN BREEDING GUARANTEES.WARRANTIES BY OWNER ONLY - Neither Auctioneer, TheBullAlley.com, Bar F Productions, Inc., nor any Sponsors or Advertisers make any representations or warranties of any kind, express or implied, about the animals sold or offered for sale. Including any warranty as to the soundness, merchantability, fitness for any particular purpose or breeding qualities or soundness of any animal offered in the sale. All such representations and warranties are hereby expressly disclaimed. "Puffery" or any other statement by auctioneer or anyone acting on its behalf shall not be considered a representation or warranty under any condition, and prospective bidders should not rely on such statements as a representation or warranty by auctioneer. Auctioneer shall have no responsibility for any written or verbal arrangements between Owners and Prospective Bidders/Buyers which differ from these conditions of the online sale.
HOLD HARMLESS - All Owners, prospective bidders and all Buyers agree to save, hold harmless, and indemnify TheBullAlley.com, Bar F Productions, Inc., it’s employees, agents, directors, sponsors, advertisers, partners or officers, and their agents, employees directors or officers, from and against any and all liability, debt, claims, suits, losses, damages, causes of action, judgments, costs and expenses; including attorney’s fees arising or allegedly arising from personal injury or death of any person or animal, including but not limited to any claims arising out of injuries or damages caused by the animal after the conclusion of the online auction including but not limited to employees of the Owner or Buyer, property damage, including loss of use thereof, economical loss or otherwise, arising or growing out of the Owner’s or Buyer’s use of any of the facilities in connection with the sale due in any manner to the negligence or intentional acts of the Owner or Buyer or any of their employees, agents or servants in the performance of the online sale or any act, error, omission or negligence of TheBullAlley.com or Bar F Productions, Inc., occurring concurrently with that of the Owner or Buyer and contributing to any loss indemnified hereunder. It is further understood and agreed that in no case will TheBullAlley.com, Bar F Productions, Inc., it’s employees, agents, directors, sponsors, advertisers, partners or officers be held responsible for any loss, damage or injury of any character to any person, animal or article arising from or occurring during the online sale.
GOVERNING LAWS - TheBullAlley.com and Bar F Productions, Inc. ("The Auctioneer") has not physically inspected any of the cattle selling with this auction for any purpose, there shall be no warranty, ownership, title, merchantability or fitness for any particular purpose of any animal offered in this sale or that the animal represented for sale is the animal catalogued. Any and all written or verbal health, medical and legal representations are made solely by or on behalf of the owner.
ALL ATTENDEES ARE URGED TO THOROUGHLY READ AND UNDERSTAND THE TERMS AND CONDITIONS OF SALE FOR THIS ONLINE AUCTION PRIOR TO PARTICIPATING. MADE AVAILABLE TO ALL PARTICIPANTS AND CLEARLY PUBLISHED WITHIN THIS ONLINE AUCTION SITE.
